Aakash Dalal asked a judge to dismiss the indictments against him.
A Hudson County Superior Court judge last week denied motions by a Lodi man to dismiss indictments accusing him of conspiring to firebomb Jewish facilities in Bergen County and threatening to kill an assistant prosecutor, The Record reported.
The trial of Aakash Dalal was moved to Hudson County after a ruling by the state Supreme Court. Dalal and co-defendant Anthony Graziano were charged with arson and bias intimidation in the 2011 and 2012 attacks on Jewish facilities.
Dalal's attorney asked that his client face trial outside of Bergen County after he was accused of threatening to kill a county assistant prosecutor.
Dalal and Graziano allegedly vandalized synagogues in Hackensack and Maywood during Chanukah celebrations in December 2011. They are also accused of firebombing synagogues in Paramus and Rutherford.
Graziano is accused of throwing the Molotov cocktails at the facilities, while Dalal allegedly plotted the attacks.
Dalal moved to toss the indictments because he said the state hadn't shown enough proof of a conspiracy between himself and Graziano and that questions posed by the Bergen County Prosecutor's Office were prejudicial.
Hudson County Judge Joseph V. Isabella denied the motions.
