City of Passaic sued over school sex assault

The student was allegedly attacked and sexually assaulted in a stairwell.

PASSAIC -- A Passaic High School student is suing the the city, the Board of Education and police department after she was attacked and sexually assaulted, according to a lawsuit. 

The lawsuit, filed recently in Passaic County Superior Court says the city, BOE and police were negligent in providing security at the school, thus leading to the attack. 

On Oct. 30, 2014, the then 15-year-old student claims that she was attacked by another student and then sexually assaulted. 

"There was a stairwell assault," John Marotta, a lawyer for the student said. 

As a result of the attack, the student suffered bodily injuries, multiple contusions and abrasion throughout her body, according to the lawsuit.

The student, whose name is being withheld by NJ Advance Media due to her age at the time of the attack, is seeking compensation for damages. 

Marotta said police have returned an indictment against the student in the case, a copy of which was not available Wednesday.

The Passaic Board of Education did not respond to a request for comment. 

Earlier this month, a former track coach at the school lost his teaching certificate after an alleged sex assault in 2006.

On Tuesday, City Public Safety Director and President of the BOE Richard Diaz was removed from his position within the district after allegations surfaced that he interfered with another sexual assault case.
