Dad sues after 3-year-old falls out of indoor bounce house, breaks leg

PARAMUS - The father of a boy who fell out of an indoor bounce house on his third birthday earlier this year has filed a lawsuit against the owners of a children's party business, claiming unsafe conditions caused his child to get hurt.

Leonardo Kondakci of New York City claims in court papers his son Daniel was bouncing May 16 at Bounce U on Eisenhower Drive when overcrowding and other conditions caused the boy to fall and break his leg.

Daniel fell "due to a dangerous condition, nuisance, improper supervision, lack of proper control, overcrowding and failure to properly maintain an inflatable bounce house present," Kondakci claims in the suit, filed Nov. 21 in Bergen County Superior Court.

According to its website, Bounce U hosts parties and offers an "Open Bounce" for toddlers and older children. A woman who answered the phone at Bounce U on Monday said there was no one immediately available to answer questions about the lawsuit.

Bounce U "owed a duty to members of the public whom they invited or permitted onto (the) premises and to provide safe conditions with proper maintenance, supervision and control," claims the suit, which names Carjon Properties LLC as defendants.

Lawyers claim Daniel Kondakci suffered serious and permanent injuries that required a cast to be set at the hospital. The child now walks with a limp, the attorneys said.

Leonardo Kondakci claims he has suffered the loss of services of his son, including guidance, companionship, assistance, household services and society.

The suit seeks unspecified compensatory damages.
