HACKENSACK -- The family of a city man killed in a confrontation with police called Tuesday on Prosecutor John L. Molinelli to present the case to a grand jury, The Record reported.
Hackensack police officers went to check on Elvin Diaz, 24, at his Temple Avenue home May 21 after he didn't show up for a probation appointment, authorities have said. Diaz attacked them with a kitchen cleaver and Sgt. Miguel Molina and Officer Elvin Hernandez shot him, City Police Director Michael Mordaga said.
Molinelli said in August that Diaz's case would be presented to a grand jury, along with that of Kevin Allen, who authorities say "menaced" police with a utility knife in the Lyndhurst Public Library.

On Tuesday Molinelli declined to tell the Record whether Diaz's case had been brought before a grand jury and if it had, what the result was, saying such proceedings are secret.
Diaz's family demanded Tuesday that Molinelli convene a grand jury. They and other protesters rallied in front of the Bergen County Courthouse.
